The present conditions of sale are concluded on the one hand by the company SASU BAR A DIY with a capital of 20,000 euros whose registered office is located at 163 Route de Marseille, registered in the trade and companies register of Romans sur Isère under the number 844 620 906, and whose intra-community VAT number is FR18844620906, and on the other hand, by any individual or legal entity wishing to make a purchase via the BAR A DIY website, hereinafter referred to as "the buyer".

The order of products on www.baradiy.com by the buyer implies acceptance of the terms and conditions described below. The buyer is invited to read them before validating his order.
This site is freely accessible to all Internet users.
Its purpose is the sale of e-liquid and accessories.
Seller reserves the right to change these terms and conditions at any time without notice and at its sole discretion.

2. Products
The products and services offered for sale are published on the website www.baradiy.com. They are marketed within the limit of available stocks.
All our products are available in our warehouse. However, if despite our vigilance, the products prove to be unavailable, we will inform you by mail or by post. The prices on baradiy.com are expressed in Euros including all taxes and do not include shipping costs.
The products offered on the site are only intended for an adult and informed public: They are not recommended for pregnant or breastfeeding women as well as people prone to cardiovascular problems.

3. Prices
The prices are indicated in Euros all taxes included and are subject to change during the year.
Prices do not include shipping and delivery costs.

4. Orders
To validate an order, the buyer must identify himself or create an account beforehand.
When opening his account, the buyer must provide the information necessary for identification.
When the order is confirmed, the customer declares that he accepts the order and the present general terms and conditions of sale. As soon as the order is recorded, a detailed acknowledgement of receipt of the order will be sent to the customer, to the email address he will have indicated when creating his customer account.

5. Payment
All orders are payable in euros. The customer has the method of payment he wants :

6. Delivery
The products are delivered to the delivery address mentioned at the time of the order.
The delivery times are given only as an indication, the delivery will be made within an average period of 24 to 48 hours from the taking into account of La Poste or depending on the delivery option chosen by the buyer when ordering. This time may vary depending on the duration of the STEEP option, if chosen by the buyer when ordering. Possible delays will not in any case give rise to the allocation of damages on the part of the seller.
Shipping costs are calculated according to the price and weight of the order. They can vary considerably depending on the geographical area and the rates applicable according to La Poste.
BAR A DIY can in no case be held responsible in case of possible incidents during transport, destruction, damage, loss or theft of products, bad weather or strikes.

7. Withdrawals
According to article L121-21, the buyer has a right of withdrawal of 14 days from the day after he takes possession of the goods ordered, without justification (provided that the article has not been used), nor payment of penalties on his part.
However, the buyer remains liable for the return costs.
Only the products returned in their entirety, in their complete and unopened original packaging will be taken back.
However, the law provides for exceptions to the right of withdrawal (Article L.221-28 of the Consumer Code): goods made to the consumer's specifications or clearly personalised, the latter applying to E-liquids. In case of return, the customer will return the goods to the seller at his own risk and at his own expense in order to be reimbursed.
Refund of all sums paid, including delivery charges, will be made within 14 days of receipt of the returned goods.

8. Responsibility
BAR A DIY® in the process of online sales, is bound only by an obligation of means; its responsibility cannot be engaged for any damage resulting from the use of the Internet network such as loss of data, intrusion, virus, break in service, or other involuntary problems.
BAR A DIY cannot be held responsible for damages of any kind, which could result from a malfunction or improper use of the products marketed.
The buyer acknowledges using these products under his full and entire responsibility and BAR A DIY will in no case be held responsible for any health problem of one of his customers.

9. Intellectual Property
All the elements of the site of BAR A DIY® are and remain the intellectual and exclusive property of BAR A DIY®. Any full or partial reproduction of the website, its transfer by electronic or conventional means, its modification, its referencing by link or its use for public or commercial purposes is prohibited without the prior written consent of the provider.
BAR A DIY® reminds the purchaser that the flavour brands mentioned are used as a necessary reference. These brands are therefore the property of others and do not belong to BAR A DIY® in any case.

10. Archiving - Proof
BAR A DIY® will archive purchase orders and invoices on a reliable and durable medium constituting a true copy in accordance with the provisions of Article 1348 of the Civil Code.

When the buyer places an order with www.baradiy.com, he consents to receive, from the supplier, communications by written or electronic mail concerning the various statuses of his order, the customer authorizes him to proceed with the processing of his personal data and to use them for purposes such as customer administration, order management, deliveries and invoicing.

12. Governing Law
The present conditions of online sale are subject to French law.
